GIANT End User License Agreement
By installing the GIANT software you acknowledge and accept this EULA and agree to these terms:
I/we agree GIANT is a U.S. Government-owned software package, this includes GIANT software User’s Manual, database of input files (with “Pedigree”) and training manuals. They may not be changed or modified in any form or fashion.
I/we agree that the software and documentation will not be re-released or redirected to any agency other than the original requestor without the prior express written approval of the GIANT Government Model Manager.
I/we agree that responsibility for further dissemination of GIANT is carried by the requestor to which, the need-to-know basis and proper security clearance are evaluated.
I/we agree the release of the software will not result in competition with software packages offered by commercial firms. I/we will not change the name of the software to avoid compliance.
I/we agree the provided software will not be published for profit. It will not be sold in any manner to the U.S. Government.
I/we agree the U.S. Government is neither liable nor responsible for maintenance, updating or correcting any errors in the software package. Errors detected in the software package will be reported to the contractor support team by email to
giant@linquest.com
or by calling the GIANT Help Desk at 937.306.6076.
I/we agree that any classified distribution will be controlled and safeguarded in accordance with any and all applicable DoD guidance, Executive Orders and security regulations.
I/we agree GIANT is intended for U.S. domestic distribution only, unless cleared by the GIANT Model Manger, International Traffic in Arms Regulations (ITAR) and U.S. government export restrictions. GIANT will not be re-directed to any non-U.S. entity. Procedures exist for non-U.S. entities to request GIANT. This does not preclude sharing of output products of GIANT with properly cleared coalition allies. In other words, the software is controlled; products, reports, etc. may or may not be controlled under these restrictions. Check with local security managers prior to release of any output products.
I/we agree that any proprietary computer software and technical data released by the Government under this Agreement will be used exclusively in conjunction with GIANT. It is acknowledged that the GIANT model contains proprietary computer software* that has been delivered to the Government with "Government purpose rights", as defined in DFAR Clause 252.227-7013 (a)(ll). I/we understand that the proprietary computer software embedded in the GIANT model has been released on a restricted basis for use only with the GIANT software in accordance with the terms set forth in this License Agreement. I/we agree to take the necessary precautions to prevent disclosure of such proprietary computer software and technical data to any party other than those individuals who are engaged in the performance work using GIANT and who have a need to be provided with access to such information in order to fulfill the requirements of the performance of work. I/we shall be solely responsible for ensuring that all personnel provided with access to the proprietary computer software and technical data understand ( 1) its sensitive and proprietary nature, (2) the restrictions on the use and disclosure of such computer software and technical data, and (3) the relationship under which I/we have been provided with possession of or access to such information.
* Specifically the following copyright protected computer software programs: TIREM, SEM, and technical data associated with these computer software programs.

GIANT Software Release Policy Agreement
All users request GIANT products through the GIANT web portal (www.giantsw.com). The current baseline version of GIANT has two products available for distribution: an FOUO basic disk that includes the software and initial database, and a classified database disk. Previous versions are no longer available for request or distribution, as AFNIC certification for those versions has expired.
There are several types of potential requestors:
U.S. Military
DoD Contractors (may include U.S. universities)
Other U.S. Governmental Agencies
Foreign Mission Partners
Decision process for releasability of the FOUO GIANT software/database product:
U.S. Military - If the requestor has an email with a .mil domain, it is approved.
DoD Contractor - A U.S. Government POC/sponsor must be provided as part of the request. This POC/sponsor will verify and vouch for the contractor's
need to know
and access to the FOUO data requested.
Other U.S. Governmental Agencies - Requests from a U.S. Government agency with access to the .gov domain will be approved.
Foreign Mission Partners - release authority for GIANT may lag the official release of software. International partners may request and will receive the current version when the release authority is updated.
Other than authorized by specific release authority to U.S. Foreign Mission Partners, the classified database is not releasable to foreign requestors and will not be distributed to non-U.S. entities.
